1. Who we are
PinwellRx LLC, a limited liability company ("PinwellRx", "we", "us"), operates this website and a technology platform that connects patients with independent, state-licensed clinicians and with independent, state-licensed pharmacies. PinwellRx does not practice medicine, does not dispense medication, and does not compound medication. Clinical decisions are made solely by the licensed clinician who evaluates you. Dispensing and compounding are performed solely by the licensed pharmacies listed in Section 7.
2. Not medical advice
All content on this website is general health information for educational purposes only. It is not medical advice, and it does not create a clinician-patient relationship. Nothing on this site is a diagnosis, a treatment recommendation, or a promise that any particular treatment is appropriate for you. Never delay seeking care from a qualified professional because of something you read here. If you believe you are having a medical emergency, call 911 or go to the nearest emergency department.
3. No offer to sell; prescription required
Listing or describing a medication on this website is not an offer to sell that medication to you. Every prescription medication referenced on this site requires an evaluation by a licensed clinician, and is prescribed only when that clinician determines it is medically appropriate. Submitting an intake form, creating an account, or making a payment does not entitle you to any medication. A clinician may decline to prescribe.
4. Compounded medications
Some medications available through PinwellRx are compounded preparations made by a state-licensed compounding pharmacy. Compounded drugs are not FDA-approved. The FDA does not review compounded preparations for safety, effectiveness, or quality, and a compounded preparation is not a generic or an equivalent of any FDA-approved brand product. Where this site describes published research, that research was conducted on the branded, FDA-approved product unless expressly stated otherwise, and those findings should not be assumed to apply to a compounded preparation. Individual results vary.
5. Eligibility
You must be at least 18 years old and physically located in a jurisdiction where we operate to use these services. You agree to provide accurate, complete, and current information in your intake and to keep it updated, including your full medication list, allergies, and medical history. Withholding or misstating information can make treatment unsafe and may result in your account being closed.
6. State coverage
Currently offering services in all 50 states plus Washington D.C. Some services may not be available in all 50 states or Washington D.C. Subject to change.
7. Pharmacy partners
Prescriptions arranged through PinwellRx are dispensed by independent, state-licensed pharmacies. PinwellRx does not own or control these pharmacies. Which pharmacy fills your prescription depends on your location, the medication prescribed, and availability. Please direct clinical and shipping questions to PinwellRx support rather than contacting the pharmacies directly.
8. Clinicians
Care is provided by independent licensed clinicians, which may include nurse practitioners and licensed providers, credentialed through our partner clinical platform and licensed in the state where you are located. These clinicians exercise independent professional judgment. PinwellRx does not direct, control, or influence their clinical decisions and is not liable for the care they provide.
9. Fees, billing, and subscriptions
Fees are shown before you pay. Subscription plans renew automatically at the interval disclosed at checkout until you cancel. By providing a payment method you authorize us and our payment processor to charge that method for the amounts disclosed. Cancellation and refund terms are set out in our Cancellation and Refund Policy, which forms part of these Terms.
10. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorized access. Do not share your account with anyone else, and do not use another person's account to obtain treatment.
11. Acceptable use
You agree not to misuse this site: no attempting to obtain medication by deception, no reselling or transferring any medication obtained through PinwellRx, no scraping or automated data collection, no interfering with the security or operation of the site, and no uploading unlawful or infringing content.
12. Intellectual property
The PinwellRx name, logo, site design, text, images, and educational films are owned by PinwellRx or its licensors and may not be copied, distributed, or used commercially without written permission. Third-party names appear only for identification and do not imply endorsement or affiliation.
13. Disclaimers and limitation of liability
The website is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant any particular health outcome. To the maximum extent permitted by applicable law, PinwellRx and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the website. Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence or fraud.
14. Privacy and telehealth consent
Your use of the services is also governed by our Privacy Policy, our Safety information, our Editorial Standards, and the Telehealth Informed Consent. You must review and accept those documents before payment is accepted.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated to registered patients. Continuing to use the services after an update means you accept the revised Terms.
16. Governing law
These Terms are governed by the laws of the State of Texas, excluding its conflict of law rules. Any dispute arising out of or relating to these Terms or the services that cannot be resolved informally will be resolved by binding arbitration on an individual basis under the Consumer Arbitration Rules of the American Arbitration Association, and you and PinwellRx each waive the right to a jury trial and to participate in a class action. Small-claims matters and requests for injunctive relief to protect intellectual property are excluded from this arbitration requirement. If any part of this section is found unenforceable, the remainder stays in effect.
